Can I Apply for Asylum After One Year in the U.S.?

  2. Attending a biometrics appointment. USCIS collects fingerprints and performs security background checks.
  3. Participating in an interview. An asylum officer reviews the claim, asks questions, and evaluates supporting evidence. If the case cannot be approved, it may be referred to an immigration judge for review.
  4. Receiving a decision. If asylum is granted, the individual gains protection from removal and can apply for permanent residency after one year. If denied, the case may move to immigration court for further review.

Applying For Asylum After the One-Year Filing Deadline

These involve sudden and unexpected changes of circumstances that significantly increase the risk of persecution in one’s home country. Examples include a sudden political shift in the country, such as political upheaval or increased violence against certain people.  Importantly, the person must apply as soon as it becomes clear that these new circumstances place them at risk.

2. Extraordinary Circumstances

These involve personal situations that directly prevented filing on time, such as:

  • A serious illness or medical condition
  • Mental health challenges
  • The expiration of lawful immigration status
  • A change in the applicant’s own personal situation, such as adopting a new religion or political belief that puts them in danger of persecution if they now go back to their home country.

The extraordinary circumstance must relate to the applicant’s inability to file earlier, and the asylum application must still be submitted within a reasonable time after the issue is resolved.
